Brook Mays Music collects SMS consent through two opt-in paths, both granting the same authorization to receive transactional rental-account notifications (payment reminders, past-due notices, payment receipts, autopay invitations, and account status updates). This page documents both paths so they can be verified by the carrier reviewer.

Path 1 — In-Store Paper Rental Contract (primary)

The vast majority of Brook Mays rental customers sign an instrument rental contract in person at one of our retail locations. The signed paper contract (form BM117, Rev. 7-10 / 4-24, TDLR approval LDW78-80) collects the customer's mobile phone number and an explicit "Permission to Text Y / N" selection in the Lessee Information block on the front page. The label is bilingual (English & Spanish, "Permiso para Enviar Texto S / N").

Consent flow on the paper contract

  1. Customer enters their mobile phone number in the Mobile Phone Number / Número de teléfono móvil cell.
  2. Adjacent cell, Permission to Text Y / N, is filled in by the customer (Y or N) at signing.
  3. Customer signs the Signature of Responsible Party / Firma de la persona responsable line at the bottom of the front page, attesting to all information provided including the SMS authorization.
  4. A countersigned copy is provided to the customer per Texas Consumer Credit Code (Reg. Z disclosure block on the contract).

What the customer is authorizing

By marking Y the customer authorizes Brook Mays Music to send SMS messages to the listed mobile number related to their rental account. Authorized message types are limited to transactional account notifications: payment reminders, past-due notices, payment receipts, autopay invitations, payment-method updates, and account status messages tied to the customer's active rental contract.

The contract preserves the customer's right to receive a copy (Reg. Z disclosure: “You are entitled to a copy of the Contract you sign.”) and the contract's Privacy Policy clause (numbered Section 23 on the reverse) states: “Lessor will not sell Lessee's personal information, without Lessee's consent.”

Customers may opt out at any time by replying STOP to any SMS, by calling 1-800-637-8966, or by emailing CustomerServiceTeam@brookmays.com. STOP / HELP / opt-out keywords are also handled automatically by the Twilio Messaging Service Advanced Opt-Out feature.

Path 2 — Online Rental Checkout (rental.brookmays.com)

Customers may also start a rental online at rental.brookmays.com. The online checkout includes a dedicated step (/checkout/phone) where the customer enters and verifies a mobile phone number via a one-time SMS code. The disclosure shown at this step is reproduced verbatim below as it appears in the published application (resource key Checkout.PhoneCollection.Form.SmsConsent in the localization bundle, English locale).

Step-by-step online opt-in flow

  1. Customer browses to rental.brookmays.com and selects a school (or chooses Adult/Home School/Private Lessons rental).
  2. Customer chooses an instrument and adds it to the cart.
  3. Customer proceeds to checkout: enters parent/guardian and student details (/checkout/customer-info).
  4. Customer verifies their email address with a one-time code (/checkout/email).
  5. SMS verification step (/checkout/phone, shown above) — customer enters mobile number; system sends a 6-digit SMS code via Twilio Verify; customer enters the code to confirm ownership of the number. The disclosure “We’ll send a 6-digit code via SMS to this number. Standard messaging rates may apply.” appears immediately below the phone field.
  6. Customer reviews the rental terms and signs the rental agreement on /checkout/review. The signed agreement contains the same SMS authorization language as the in-store paper contract.
  7. Customer pays the deposit on /checkout/payment and receives a confirmation.

An immediate welcome SMS is then sent: “Brook Mays Music: You're now subscribed to rental account notifications. Msg frequency varies (1-8/mo). Msg & data rates may apply. Reply HELP for help, STOP to opt out.”

Public Mobile Terms & Privacy Policy

The following CTIA-required disclosures are publicly available without login at brookmays.com/mobile-terms-conditions and brookmays.com/privacy-policy.

  • Program name & sender: Brook Mays Music Company.
  • Message types: Instrument rental contracts — payment reminders, past-due notices, payment receipts, account status updates, two-factor authentication codes.
  • Message frequency: Typical usage is 1–8 messages per month.
  • Cost disclosure: “Message and data rates may apply.”
  • STOP keyword: “Text STOP to any message to stop receiving text messages.”
  • HELP keyword: “Text HELP to any message for help.”
  • General carrier disclaimer: “Carriers are not liable for delayed or undelivered messages.”
  • Privacy policy link: Cross-linked from the mobile terms page.
  • No-share / no-sell: “We do not share your phone number or text messaging opt-in consent data with third parties for marketing purposes.”

Phone numbers and opt-in records are retained for up to 3 years after opt-out to evidence consent, per the SMS section of the privacy policy.
